Privacy Policy Guide for Texting & Branded Calling ID
Privacy Policies are needed for both services. When registering for texting campaigns a privacy policy is mandatory during vetting to ensure consumer data isn't transferred among various organizations.
SMS Privacy Policy Must-Haves:
-
Accurately describe the SMS program/service, including when and what type of messages users will receive.
-
List the type of personal information you collect (name, email, phone, etc).
-
List the methods you use to collect personal data (a form, cookies, etc).
-
Explain how you're using this personal data (to send emails or text messages, etc).
-
Explain how you store, maintain, and protect the personal information you're collecting.
-
Explain if, how, and why you share personal data with third parties.
-
Provide clear options for customers/visitors to correct, verify, change, or remove their personal information.
To successfully address these requirements, we recommend adopting and including a process in the Privacy Policy that demonstrates senders will refrain from sharing consumer data to third parties for marketing purposes. An example is below:
Example: "Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties."
A privacy policy that does not accurately or adequately disclose your practices can expose you to legal risks. We recommend consulting with your legal counsel before adopting this privacy policy.
